1. Terms and Conditions of Use

1.1. Before using the website www.spaceylon.gr, please take some time to read the following terms and conditions that contain important relevant information. The use of the website shall constitute a presumption that you have read and agree with these Terms as well as with the  Policy of online orders, payments and shipments, the Return Policy , the Privacy Policy (Company Policy on Personal Data) and the Cookies Policy, as amended and in force, and that you shall be bound by them, otherwise you are called to stop using the website immediately.

1.2. Your agreement as well as the full and unconditional acceptance of the Terms and the Policies is expressed, certified and declared by using the presentation and/or by clicking on the link “I have read and agreed to the Terms and Conditions ” or on any other link related to the shopping process or use of spaceylon.gr website and is considered to be your signature on this document.

1.3. These Terms and Policies may be amended. It is your responsibility to regularly read through them, as the Terms and the Policies in force at the time that you use this website or at the time of the formation of the Contract (meaning the purchase)  shall be the applicable ones.

1.4. This website (hereinafter “Website” or “Webpage”) belongs to the company under the name “DOSHA O.E” (foreign language “DOSHA GP”)  (distinctive name: “Spa Ceylon Hellas”), hereinafter DOSHA O.E. or Company, based in Dionisos, Attica (131 Dionisou Street., P.C. 14576). Any questions, clarifications or complaints, regarding the Website and these terms and conditions, should be addressed to “DOSHA O.E.” at the following email address: info@spaceylon.gr.

1.5. “DOSHA O.E” is the AUTHORIZED (sole and exclusive) DISTRIBUTOR of the products of JANET LANKA (PVT) LIMITED (hereinafter referred as Janet) in Greece. DOSHA O.E. is the sole and exclusive owner of the Website and the code contained therein. DOSHA O.E.  has been given the permission to use all documents, records, texts, images, graphics, accessories, and the general depiction of the website, and all rights (including copyright) arising from them, by JANET, as the sole and exclusive AUTHORIZED DISTRIBUTOR of the products under the trademark spaceylon in Greece. The copyright of the content of this Website (that meaning the products)  is intellectual and industrial property of JANET unless otherwise specified and protected by the relevant provisions of Greek, Community and international law. All product names mentioned in these and especially the trade mark SPA CEYLON  constitute trademarks of JANET. The use of the Website, as well as posting, copying, storage, modification and/or distribution of their content (in whole or in part), without the prior written permission of “DOSHA O.E.”, shall be strictly prohibited.

1.6. “DOSHA O.E.” has made every effort to ensure the accuracy of the content at the time of publication (e.g., description of products, pricing, etc.). To the extent permitted by the applicable legislation, “DOSHA O.E” shall disclaim all warranties, explicit or implicit, as to the accuracy of the information contained in the Website; therefore, “DOSHA O.E.” will not be held liable for any loss or damage, which may result from their use.

1.7. The use of the Website is intended only for adults and “DOSHA O.E.” shall bear no responsibility in case minors use the Website.

1.8. All the prices of the products displayed on the website shall include VAT, as in force in Greece. The indicated prices shall be subject to change without further notice.

2. Policies for online orders, payments and shipments

2.1. Online Orders

The order will be shipped by ACS courier company only and strictly in Greece.

Before finalizing the order with an obligation to pay, the user shall be required to check the details contained therein in order to be sure for the products he has chosen, the quantity, the final price, the method of receipt. The final image of the order includes a description of the products, quantity, total cost, namely price, VAT, any shipping costs. After receiving the online order, the availability of all the products included in it shall be checked.

In case there is availability of all the products included in your order, within the time specified for delivery indicated below, then you will be sent a confirmation message to the e-mail address you have declared, which will inform you about the order and will include all its details. The final order submission shall consist a binding proposal to purchase on part of the user, with an obligation to pay. The sales contract shall be deemed to have been concluded after the above product availability check has been carried out and the user has received a confirmation message at his email address.

“DOSHA O.E.” and/or the cooperating courier, ACS, may contact users via email, via SMS or any available application for sending/receiving messages, throughout the duration up to the delivery of your order to you, for any issue related to the receipt, the processing, execution and/or transport of your order and/or payment and/or return of products or for any other relevant issue. The parties agree that this communication shall also cover the legal requirements of written information, notification, order confirmation, where and when required by law.

Shipping and Delivery:

“DOSHA O.E.” ensures the immediate delivery of your products throughout Greece by offering FREE shipping for purchases over €45. Your orders are delivered by ACS.

For orders less than €45 the shipping costs are €3.5/2kg (surcharge per additional kg is 1.30€). 

Your orders are shipped usually on the next business day, depending on the availability of products and the time of the year (official holidays, festive period etc). In cases involving hard-to-access areas or remote destinations, the delivery time may vary.

Delivery within Attica and land destinations:

Orders placed before 12:00 p.m. will be delivered in the next 1-2 business days.

Delivery to island destinations and outside city limits:

Orders placed before 12:00 p.m. will be delivered within 2-5 business days.

Orders placed on public holidays begin to be processed on the first business day after the last day of the public holiday. The estimated delivery time starts from then.

Please note that Dosha is not responsible for late/failed deliveries due to reasons beyond our control, such as in cases of extreme weather conditions.

2.2. Methods of payment

2.2.1.Credit card payment

DOSHA O.E. accepts all Visa, Mastercard, Diners and American Express debit, credit and prepaid cards, as well as Viva Wallet cards. Your transactions at our e-shop are made through Viva Wallet’s online payment service.
For credit card purchases, you should follow the instructions mentioned in the e-shop. In the order form you will need to fill in your credit card number and expiration date. The credit card will be charged after preliminary inspection and certification of data and validity. You are the only responsible for the true and accurate recording your credit card data. The buyer must also be the holder of the card used in the transaction. The same applies if you order for a company. In this case, the card should be a corporate one and the name of the recipient should be written on the card.

2.2.2. Payment upon delivery of the order to your place (Cash on Delivery Service).

You will have to pay the courier officer who will deliver the order to your place, acting on DOSHA’s O.E. behalf. There will be an extra charge of 1,60 Euros.

2.2.3. Payment by bank deposit

You could either choose to pay your order through a bank account.

Your order will be shipped, as soon as we receive the copy of the bank transfer payment.

Important Notes:

1. The collection and processing of the payment details you send shall fall within the strict privacy policy governing your transactions. For more on the privacy policy and the protection of your personal data, please refer to the section entitled “Company policy on Personal data” of these terms. For card payments, in cooperation with the cooperating financial and non-financial organizations and points of sale, all necessary security measures shall be taken to ensure the maximum possible protection in your electronic transactions and to ensure your payments shall be exclusively carried out in a banking environment.
2. In any case, the shipment time of orders shall depend on factors which are outside the control of “DOSHA O.E.”, such as any force majeure events or delays attributable to the courier companies cooperating with the points of sale or “DOSHA O.E.”.

3. Cancellation – Return Policy.

3.1. Cancellation

 It is not possible to cancel orders that have been submitted through the website, after their finalization. Otherwise, contact us at 210 8150124.

3.2.Defective Products

In case of a defective product, you may contact the Company in order to have the product replaced. Our Company shall replace the product if law requirements comply with the Company’s Return Policy. In case of Product Return, if you ask for its replacement, you shall receive a discount coupon code of an equal value in order to use it to purchase other product(s) or simply replace the returned product.

3.3 Right of Withdrawal

You have the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period shall expire 14 calendar days from the next day on which the Customer or a third party designated by the Customer (other than the courier) acquires physical possession of the goods.

In order to exercise their right of withdrawal, the Customer shall notify DOSHA O.E. located  in Dionisos, Attica (131 Dionisou Street., P.C. 14576) (tel.: 210 8150124, e-mail: info@spaceylo.gr) of their decision to withdraw from the Contract.

The right of withdrawal, as provided for in Greek Law Articles 3e to 3ia L. 2251/1994, shall not apply for: a) the provision of goods which are liable to deteriorate or expire rapidly b) the provision of sealed goods which are not suitable in case of return for reasons of hygiene or health protection and have been opened after delivery; c) the provision of custom-made goods; and d) the provision of goods which, after delivery, are, by their nature, inseparably mixed with other goods.

To meet the withdrawal deadline, it is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. Items must be returned in their original condition along with their relevant documents (receipt – invoice).

Credit/debit card transactions cancellations are refunded within 14 calendar days.

Important notice: Before taking any action, you are kindly requested to contact us by phone or e-mail) so as to guide you on the steps to be taken depending on your case.

3.4. Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, excluding  the direct cost of returning the products, namely in case of return by a courier company, the transport costs which shall be borne by the users. The reimbursement will be fulfilled  without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement, unless you select a different refund method (other than the one used in the first transaction). In this case, the cost shall be borne by the Customer and will be deducted from the amount to be refunded. “We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.” You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods (the handling and examination of the goods shall be made in a way that allows customers to examine them as if they were in an actual store).

In particular for refunding: Especially, in the event you pay cash on delivery at your home or in any event refund is not possible because of the way of payment you used in the original transaction, any refund of money in case of withdrawal shall be made – upon mutual agreement – by deposit to your bank account.

Please note that open products are not eligible for return.

3.5. Product Return Process

Return Process: Firstly, you need to place the product(s) in their original packaging, along with a copy of the completed withdrawal form (PDF), which was attached to the order’s confirmation e-mail.

You are then kindly requested to send it to the Returns Department via its original carrier.
For a product return due to withdrawal, you should call any courier of your choice and send us the parcel to the address below at your expense:

4. Company policy on personal data.

4.1. General information

The Company under the corporate name  DOSHA O.E. is responsible for any processing of personal data carried out by the Company or its partners, exclusively for the purposes and in the manner determined by the Company. DOSHA O.E. respecting the relevant legislation, implements the appropriate measures to ensure the security and confidentiality of your personal data. The purpose of this privacy policy is to inform you about the processing of the personal data that we collect from you when you visit our website.

The use of this website implies the acceptance of this Privacy Policy, i.e. your consent on the collection, use, and further transmission of your personal data for purposes related to the use of our website and the provided services. 4.3. Personal Data collected by the website

Visits to www. Spaceylon.gr  website do not involve the automatic registration of any personal data that identifies you. However, there are some non-personal or identifiable information that can be collected and complied with on the www. Spaceylon.gr   website (for example, the type of user’s Internet browser, the user’s operating system for accessing websites on the site ) in order to improve our services, such as the experience of navigating and managing the www. Spaceylon.gr   website. Furthermore, we automatically collect information about you, such as your e-mail address (IP address) and your domain name. However, in order to use certain services on our website, place an order and enjoy our services you may be asked to provide personal information such as name, surname, address, telephone number, email address, and, if you wish to issue an invoice, your company name, profession, TIN and Tax Office.

4.11. Data retention period

All personal data is kept for a predetermined and limited period depending on the purpose of processing, at the end of which, such personal data is deleted from our databases. The personal data you provide to our Company through this website or in other ways will be kept for as long as you wish to enjoy our services and related updates as above, and you can revoke your consent at any time. In the case of a sales contract with DOSHA O.E.  a reasonable period of retention of your personal data is five years from the completion of the sales contract. The time that your Personal Data can be retained by our Company additionally depends on the relevant obligations of our Company provided in the current legislation (tax, etc.) and the provisions of the law for their maximum retention period.

5. Security

Today SSL (Secure Sockets Layer) protocol, is the worldwide web standard for website certification among internet users and also for element encoding among users and web servers. An encrypted SSL communication requires all information sent between the client and the server to be encrypted from the sending software and decrypted from the receiving software, protecting in this way personal information during the transfer. Also, all information sent with the SSL protocol is protected by a mechanism that automatically verifies if the data have changed during the transfer.

Private security is also consisted from the password you give when you become a user of www.spaceylon.gr  In order for us to show any personal data the username and password must first be provided. For this reason you should keep safe these data in order not to be known to third parties. We also advise you to create passwords consisted of symbols with alphabetical and numerical characters.

We should, finally, remind you that all transactions taken place through this website are regulated by International and European Law, which regulates issues regarding e-commerce and also by the Law on consumer protection (L.2251/1994), that regulates issues regarding distance selling.

6. Computer security and damage.

Although “DOSHA O.E.” takes all reasonable steps to ensure that the Website is free from viruses or defects, it cannot guarantee that their use or links to other websites contained therein will not cause damage to a user’s device. “DOSHA O.E.” shall bear no responsibility for any loss or damage caused to a user’s device, as a result of using the Website/application.
